Days dedicated to the law of yachting and pleasure craft
The French association Légisplaisance organizes every year since 2016 the National Days of Yachting Law. On this occasion, it brings together the actors of the sector around specific issues to work and exchange; In 2022, the 6th edition will be devoted to the evolution of professional yachting and yachting, under the angle: what legal, economic and social issues? Public and private actors will meet at the casino of Beaulieu-sur-Mer on June 9, 2022.
"It is a topical issue for a sector, in line with the Fontenoy of the maritime industry with a large wage bill and seafarers subject to strong competition. The subject is recurrent at the ENIM where I also work. The idea is to put everyone around the table to talk to each other and allow the State and professionals to know each other better and talk. We want to bring crews and employers shipowners" explains Jérome Heilikman, president of the association.
Training and qualification of crews
During a first round table, the issues of training for seafarers will be discussed. Crew qualification, equivalence of certificates, work methods and the advent of an equivalent to wage portage will be among the topics discussed by the representatives of the Maritime Affairs, placement companies and online platforms gathered for this debate.
Taxation of yachting
In a second phase, the theme of French taxation on large yachts and its effects on the sector's activity will be discussed. The role of the RIF flag and the themes of VAT and fuel taxes in a context of border competition will be on the menu.
Labour law for seafarers
With the Pôle Emploi of Antibes and lawyers, a third round table will focus on labor law. "This will focus in particular on individual litigation and the jurisdiction of the court, depending on the employer, the flag of the boat, the place of residence of the sailor... The issue of French social security is an important lever for the attractiveness of the flag" underlines the president of Legisplaisance.
Adapting ports to large-scale yachting
To close the day, the port theme will be addressed, to reflect on the specific needs of yachts and the implication in terms of rights and responsibilities. "There has been a lot of change in the Mediterranean recently in the management of moorings," says Jérome Heilikman. The role of shipyards will also be on the table.
